The ADR Society @ The Annual CIArb Mock Arbitration

The Chartered Institute of Arbitrators UK (Nigerian Branch) held its Annual Mock Arbitration at The Nigerian Law School (Lagos Campus) on Wednesday, 16th of March 2016 and representatives from The Alternative Dispute Resolution Society (UNILAG) were welcomed as special guests, thanks to the ever lovely Mr. Greg Nwakogo MCIArb, Managing Partner, Roseberg Legal Practitioners & Arbitrators.

The event was an exciting one as the mock scenario featured a challenge of the jurisdiction of the Arbitral Tribunal to entertain the matter between Megacorp Bank Plc & Archibuild Ltd. In summary, the former entered into an agreement with the latter under which the latter was to build an office complex for the former. However, the contract wasn’t completed and Megacorp had to solicit the services of another building company to get the job done properly. The agreement had an arbitration clause but for reasons best known to them, Megacorp decided to sue. After Archibuild had filed all the necessary documents and their issues had been joined, Megacorp sought to revert back to Arbitration. Hence, the challenge of the tribunal’s jurisdiction to hear the matter.

An interesting debate ensued between both parties and all that were in attendance watched very closely as the hearing unfolded and as the tribunal which was headed by the President of the Lagos Court of Arbitration, Mr. Yemi Candide-Johnson worked its way to a final decision – the award.
